  • These terms and conditions (“Ts and Cs”) apply to all
    bedroom reservations made at the Tynecastle Park Hotel, owned and operated by
    Heart of Midlothian PLC (herein referred to within as “we” or “us”, the "Hotel",
    Company” or “HOMPLC”) whose address is at Tynecastle Park,
    McLeod Street, Edinburgh, EH11 2NL.

    You will be asked to confirm your acceptance of and agreement to
    be bound by these Ts and Cs each time you make a reservation. We reserve the
    right to amend these terms and conditions at any time and you should therefore
    check them carefully when making a reservation and in advance of your stay at
    the Hotel.

    i.            You
    must be at least 18 years old in order to make a reservation and guest bedrooms
    must be occupied by at least one individual who is aged 18 or above.

    ii.
              Check in is from 15:00. There is
    a 24 hour Reception.

    iii.          Check
    out is by 11:00 (unless expressly stated otherwise at the time of booking or
    otherwise agreed in accordance with these Ts and Cs).

    iv.          Breakfast
    is served in The Skyline Restaurant: Monday – Friday 06:30 – 10:00. Saturday –
    Sunday 07:30 – 10:30.

    v.           For
    reasons of health and safety a member of staff is required to have access to
    guest bedrooms a minimum of every 24 hours.

    vi.
             Fire Alarm tests are held every
    Friday between 11:00-12:00.

    vii.
            It is the responsibility of the
    guest to advice the Hotel of any allergies or intolerances they have before
    consuming food or beverage.

    ii.
              Guarantee – pre purchase rate:
    A valid credit or debit card must be given to guarantee your reservation and
    make the payment for the reservation in full. A payment link may be sent to the
    guest to complete prior to arrival to process the payment. The same card used
    to pay online must be presented to check in to the hotel or the guest must
    provide alternative pin verified card details upon check in. We reserve the
    right to cancel your reservation anytime between the time of booking and the
    day of arrival if secure payment cannot be taken.

    iii.
             Check in: A credit card must
    be provided on check in and a preauthorisation for the total sum of the
    reservation plus £50 per room to allow for any extras will be taken using the
    credit card. Payment of incidentals by cash, debit card, Apple Pay or Android
    Pay is possible only at the time the charges are taken. In the interest of
    clarity, credit cannot be opened within the hotel using theses payment types.
    Please note that due to banking industry policy and procedures, the funds
    preauthorised plus the final amount due may remain ring fenced on a credit or
    debit card for up to 30 working days.

    iv.
             Increasing your credit limit:
    Should charges added to the bedroom exceed the preauthorisation sum taken on
    check in, the Hotel reserves the right to carry out a further preauthorisation
    for charges or anticipated charges for the duration of the guest stay.

    v.
              Maximum credit limit:
    Guests may be permitted to have a bill for up to a maximum of £500 at any given
    time, at which point they are required to pay the bill in full using their pin
    verified credit or debit card at Reception.

    vi.
             Ad hoc charges: Guests who
    request for the Hotel to source external services or products for them are
    required to pay any external supplier directly. This includes but is not
    limited to travel arrangements and tickets to sporting or music events etc. The
    exception is for taxi charges using the designated Hotel partner.

    vii.
            Gift voucher: Payment by
    gift voucher is only accepted if the physical gift voucher is presented upon
    arrival. Vouchers are redeemable from seven days after purchase until the
    outlined expiry date. All of these Ts and Cs apply when payment is made by gift
    voucher.

    Cancellation of a reservation is only valid on receipt of a
    cancellation confirmation email.

    i.            Flexible rates

    (a)         Cancellation: There will be no
    cancellation charge if the booking is cancelled before 3pm (15:00 GMT) 1 day
    before your date of arrival. Notification received after this time will incur a
    charge equating to up to the first 2 nights of the reservation at the full rate
    booked.

    (b)
            No show: Failure to contact us by
    email or arrive before check-out time after the first night of a reservation
    will result in the automatic cancellation of the remainder of your reservation,
    and charges will be incurred equating to up to the first 2 nights of the
    reservation at the full rate booked.

    ii.           Advance
    purchase rates

    (a)
             Cancellation: On advance purchase
    rates a credit or debit card is required to charge full  prepayment at the time of booking, in the
    event of a cancellation there shall be be no refund. Bookings made on this rate
    are, in all circumstances, non-amendable, non-refundable and non-transferable.

    (b)
            No show: Failure to contact us by
    email or arrive before check-out time after the first  night of a reservation will result in the
    automatic cancellation of the remainder of your reservation without refund.

    (c)
             You authorise that your card is
    charged the full amount, anytime between the time of booking and the day of
    arrival.

    (d)
            In the event the card details are
    unable to be charged for any reservation made under an advance purchase rate,
    the Hotel reserves the right to cancel the reservation in full at any time.

    All packages and offers can be withdrawn without prior notice and
    are subject to availability. When booking a package inclusive of an allocation
    towards food, please be aware that a dinner reservation is strongly recommended
    and up to seven days' notice may be required to avoid disappointment for
    availability in the Skyline Restaurant. Please note dinner packages can only be
    redeemed for table bookings of up to 4 adults.

    Any ‘add ons’ can be withdrawn by the Hotel without prior notice
    and are subject to availability. These must be booked at least 48 hours in
    advance of your arrival date to be guaranteed and are non-refundable. All
    packages will be in the bedroom for guest arrival from 3pm.

    All bedrooms are air conditioned and feature an en-suite bathroom
    with a monsoon shower and bespoke toiletries. Bedrooms include a desk area, in
    room telephone, and digital TV's inclusive of Freeview channels, access to
    complimentary WiFi, tea & coffee station with biscuits, mineral water,
    ironing facilities and a hairdryer.

    Note, guests who book a Roseburn
    Room may be given a Wheelchair Accessible room based on availability.

    All Roseburn rooms are internal
    rooms without natural daylight. They come with a virtual window which displays
    a live camera feed showing the inside of Tynecastle Park stadium. In the event
    of a closed doors training session or match, the live feed will change to show
    live feed of Edinburgh’s skyline

    Guest bedrooms accommodate a maximum of two adults and up to one
    cot for a child aged under 2. Babies and toddlers aged up to 2 years will be
    provided with a baby cot on a complimentary basis (subject to availability).

    Smoking is not permitted in any part of the Hotel. Guests found to
    be smoking in in/on any part of the premises will be subject to a minimum
    additional charge of £100, which will be charged to the debit or credit card
    provided to guarantee or pay for the reservation. In the event that no debit or
    credit card was provided, on check-in the Hotel reserves the right to
    immediately terminate the reservation and request their immediate departure.

    a) In the event of the fire alarm system sounding, all persons
    within the building must make their way to the Fire Muster Point and report to
    the Roll Call taker who will be wearing a high visibility jacket.

    b) Guests must make themselves known to Reception upon check in if
    they will require assistance to evacuate the building in the event of an
    emergency, and will be requested to complete a Personal Emergency Evacuation
    Plan. This includes guests with limited mobility, and sight or hearing
    impairments, as well as children aged below 16.

    c) Evacuation caused in the event that the fire alarm system is
    triggered by a guest tampering with the fire detector, smoking, or using
    unauthorised equipment or items including sparklers, candles, and gas burners,
    the guest will indemnify the Hotel from any liability in respect of any injury
    to or death of any person, damage to any property or all and any losses
    howsoever suffered by the Hotel as a result of such actions and others by the
    guest and from all proceedings, costs, claims and demands in respect of any
    such liability or alleged liability.

    We are entitled to recover from a guest,

    (a) the cost of repairs or replacements of any damage or loss
    caused by the guest, or their pets, or others from whom they are responsible
    and

    (b) loss of revenue caused by a bedroom damaged by a guest being
    unsellable, at the room only best available rate, until the bedroom can be
    resold, up to a maximum of 3 nights after the guest leaves the premises, or
    when the damage was occurred, whichever is the later. Full payment for such
    damage or loss will be charged to the credit or debit card held on file for the
    room occupied by the guest concerned. We also reserve the right to terminate,
    without compensation or further obligation, the reservation if it is deemed
    that the guest's behaviour is unsociable, abusive or in any way unacceptable to
    ourselves or any other guest. In such circumstances the guest accepts that they
    will be required to immediately leave the premises.

    The Hotel is not responsible for lost, damaged, or stolen personal
    items. Should any guests lose or leave personal belongings, if recovered, the
    item will be recorded as 'found'. The Hotel will keep detailed records of all
    'found' items and will ship items back at the owner's expense on request. Any
    items in Lost & Found, which are not claimed within ninety (90) days, will
    be donated to a local charity or discarded.

    24 hour CCTV cameras are fitted throughout the public areas of the
    Hotel for the safety of all concerned. By staying at the Hotel, guests agree to
    be filmed using our CCTV equipment, in accordance with the Customer Fair
    Processing Notice found on our website www.tynecastleparkhotel.com..

    The Hotel accepts no liability for cars, motorbikes and general
    property kept in our car park.

    i.
               The Hotel needs to keep certain
    information about its guests for the purposes of processing reservations, guest
    care as well as health and safety compliance and legal obligation. Any
    collection and processing of guests’ personal data will be done so in
    accordance with the Customer Fair Processing Notice found on our website
    www.tynecastleparkhotel.com.

    ii.
              All HOMPLC employees who process
    or use any personal information must ensure that they follow these principles
    at all times. HOMPLC as a corporate body is the data controller under the GDPR,
    and the Board is therefore ultimately responsible for its implementation.

    iii.          Access to the reservations to amend or
    cancel will only be granted to persons who can confirm the full guest name,
    dates of stay, and full confirmation number. [Exceptions may apply to
    reservation made through the Global Distribution System.]

    iv.
             Requests for invoices must be
    made in writing to Reservations and confirm the full guest name, dates of stay,
    and full confirmation number.

    v.           It is a common gesture from friends
    or family of a guest to request that a gift or message be left as a surprise
    for them in their room. This can be arranged if the requesting party confirms
    the full guest name and dates of stay. If guests do not wish for the Hotel to
    confirm that you indeed have a booking with us, you must advise this at the
    time of booking.

    vi.          Our Customer Fair Processing Notice
    highlights that any accidents, near misses, or alleged food poisoning incidents
    will be reporting to a third party for further investigation and the guest may
    be contacted for further information.

    HOMPLC are unable to provide storage facilities for fire arms and
    under no circumstances should fire arms be left within the Hotel, or grounds by
    a guest. Failure to comply with this requirement and resulting consequences
    will be the sole responsibility of the offending guest. Therefore, no liability
    can be accepted regarding the transport of storage of fire arms.

    Guests wishing to bring their own electrical equipment for use
    within their room are reminded that in the UK, the declared voltage and
    tolerance for an electricity supply is 230 volts -6%, +10%. Guests are
    responsible for ensuring their own equipment is safe to use (has passed a
    Portable Appliance Test {PAT}). The guest will be responsible for any and all
    damage to hotel property and infrastructure resulting from a faulty device
    being connected to the hotels mains supply. All personal electrical or electronic
    devices that are brought in to the hotel are used entirely at the owner's risk.
    The hotel will not be responsible for any damage to such appliances under any
    circumstances.

    i.
               Third parties are not
    authorised to market the Tynecastle Park Hotel brand in any form without
    written authorisation from the Company.

    ii.
              Experiences and credit including
    but not limited to, overnight stays, gift vouchers, and dining are
    non-transferable. As such, are not authorised to be included as part of a
    prize, competition, giveaway, or sold package without written authorisation
    from the company.

    iii.
             Images, marketing material, and
    company logo are the intellectual property of HOMPLC and are not authorised for
    use or publishing by any other company without written authorisation from the
    company.

    We regret that we cannot accept liability or pay any compensation
    (or refund) where your stay or experience with the Hotel is prevented or
    affected by' Force Majeure'. In these booking terms and conditions, 'Force
    Majeure' is defined as any event not within our reasonable control. Such events
    may include sleep disturbance from fellow guests, disturbance from emergency
    evacuations, fire, adverse weather conditions, industrial dispute, epidemic or
    pandemic and all other events outside of our control.

    Should there be a third-party systems issue which allows a bedroom
    to be booked / reservation to be made at an incorrect rate and / or when there
    is no availability for the required night(s), the Company reserves the right to
    cancel the booking. The Company will refund any monies paid toward the booking,
    and accepts no liability for costs or disappointment incurred. The Company will
    make their best endeavours to contact the details given on the reservation as
    soon after the booking is made to offer alternative dates or advise of the
    cancelation.

    We further reserve
    the right to:

    change
    your room allocation at any point during your stay for any reason; or

    cancel any reservation(s) due to health
    and safety concerns or full or partial closure of the hotel. In the event
    we have to cancel your booking(s) we will attempt to notify you and a full
    refund will be processed to the same debit/credit card.

    This contract formed
    when we confirm your reservation is between you and us. No other person shall
    have any rights to enforce any of its terms, whether under the Contracts
    (Rights of Third Parties Act) 1999 or otherwise.

    If you are a
    non-business customer you have certain rights under consumer protection
    legislation. Nothing in these terms and conditions is intended to affect those
    rights.

    We accept liability
    for death and personal injury arising from our negligence or that of our
    employees and agents. We do not seek to exclude our liability for fraudulent
    misrepresentation by us or our employees or agents.

    If we breach these
    terms and conditions for reasons within our control we shall only be liable for
    losses that are direct losses and a reasonably foreseeable consequence of such
    breach.

    Save as prohibited
    by applicable law, we shall not be liable whether in contract, delict
    (including negligence) or for breach of statutory duty, or in any other way,
    for any indirect or consequential losses including:

    Where we are liable
    to you (save as prohibited by applicable law) our maximum liability to you
    whether in contract, delict (including negligence) or for breach of statutory
    duty shall in no event exceed the price of your reservation unless the Hotel
    Proprietor's Act 1956 applies, in which case our liability will be limited to
    the maximum prescribed under that Act.

    These terms and
    conditions, their subject matter and formation (and any non-contractual
    disputes or claims) are governed by and construed in accordance with Scots law.

    If you are a
    consumer, you and we both agree that the Scottish courts will have
    non-exclusive jurisdiction over any claim arising from, or related to, your
    reservation and/or stay at the Hotel. We retain the right to bring proceedings
    against you for breach of these terms and conditions in your country of
    residence or any other relevant country. If you are a resident of Northern
    Ireland you may also bring proceedings in Northern Ireland, and if you are
    resident of England or Wales, you may also bring proceedings in England or
    Wales.

    If you are making a
    business reservation, you and we agree that the Scottish courts will have
    exclusive jurisdiction over any claim arising from, or related to your
    reservation and/or stay at the Hotel.

    If any part of these
    terms and conditions is deemed invalid, illegal or for any reason unenforceable
    then that part will be deemed deleted and will not affect the validity and
    enforceability of the remaining parts. Any failure by us to enforce our rights
    or remedies under these terms and conditions or otherwise shall not be
    construed as a waiver by us of those or any other rights or remedies.

    All rights not
    expressly granted in these terms and conditions are reserved.

  • 1. Concessions are defined as all those Under 18 years of age, OAPs over 65 years and students in full time education. Proof of age (including matriculation ID card for students) is required. Only photographic identification will be acceptable. Where concession categories are broken down individual specific age groups or categories apply. Anyone found incorrectly using any ticket type who does not meet the criteria for that ticket will be removed from the ground and no refund will be given.

    2. From time to time, the club may wish to keep you up to date with the latest information from the club. Such communication includes email, text, telephone and direct mail and will only involve activity directly related to the club. If you do not wish to receive such information please alert us at the time of sale or tick the appropriate box on the application form. You can be removed from this database at any time by emailing tickets@homplc.co.uk or calling 0333 043 1874, option 1, then option 8 (Monday to Friday, 9am-6pm).

    3. From time to time, the club teams up with a selection of carefully chosen commercial partners to bring fans a diverse range of opportunities. If you do not wish to receive such communication please alert us at the time of sale or tick the appropriate box on the application form. You can be removed from this database at any time by emailing tickets@homplc.co.uk or calling 0333 043 1874, option 1, then option 8 (Monday to Friday, 9am-6pm).

    4. Please note that you must include all payment information. You should ensure you have sufficient funds in order that payment may be taken as instructed. Applications where payment is declined will be considered void.

  • 1. Match tickets are issued by, and shall remain the property of, Heart of Midlothian plc.

    2. Tickets shall be void if re-sold at a premium or for commercial purposes, or used as prizes in competitions or lotteries, without the clubs’ prior written consent.

    3. Tickets are issued subject to the Tynecastle Stadium Ground Regulations, copies of which are available from Heart of Midlothian.

    4. Match tickets are non-refundable. No refund for a ticket will be made if the match is postponed and played upon a future date (although this ticket will, unless otherwise advised by the club, remain valid for that match), or if the match is abandoned.

    5. If you lose your tickets the club cannot offer reprints for tickets once they have been dispatched from the Ticket Centre.

    6. No photographs, video recordings, sound recordings or similar may be made within the stadium without the clubs’ prior written approval. Entry to the stadium may be denied to persons with audio, visual and/or audio/visual recording equipment of any sort, or anyone who is (or becomes) under the influence of alcohol, or is carrying any articles prohibited by the Criminal Law (Consolidation) (Scotland) Act 1995.

    7. Any person seeking to use a Ticket in breach of these conditions may be denied entry to the stadium or ejected from it. In any such event that person may also be subject to legal action by the club, and the club reserves the right to retain any money paid for the Ticket.

    8. Admission cannot be guaranteed if the bearer arrives at the stadium less than 30 minutes before the advertised kick-off.

    9. On entering the stadium, the bearer must retain the Ticket for the duration of the match.

    10. The failure, or delay, by the club to exercise a right or remedy under these terms and conditions or by law does not constitute a waiver of that (or any other) right or remedy.

    11. These terms and conditions are governed by Scots law, and any dispute relating to them shall be subject to the exclusive jurisdiction of the Scottish courts.

    12. Under 13’s match tickets can only be bought in conjunction with a full paying Adult priced ticket. There is a limit of two U13 tickets per Adult ticket. Where there is no Adult ticket purchased, an U18 should be purchased.

    13. Student tickets are only available to purchase from the ticket office directly. In order to purchase student tickets, a valid student ID that states you are studying full-time is required.

    14. For any Category A matches the club will only sell tickets to customers who have an active account and recent purchase history. If you fail to meet this criteria you will be refused sale.

  • Warning: It is an offence, punishable by law, for any person to enter, or attempt to enter, the stadium:

    1. Whilst in the possession of a controlled container, which is or was capable of holding liquid and which if thrown was capable of injury to another person, or any other prohibited articles (such as cans, bottles, flasks, fireworks or flares).

    2. Whilst in possession of alcohol.

    3. Whilst under the influence of alcohol.

    In the interests of safety, the instructions of the Police and stewards must be obeyed at all times.

    Please note that smoking is strictly prohibited at Tynecastle Stadium.

  • Under the Licensing (Scotland) Act 2005, when the Club sells tickets for corporate match day hospitality which includes alcohol, the maximum number of drinks per person will be limited to ten. This is to ensure that the Club does not breach the terms of the mandatory conditions placed by statute on the Premises Licence.

    Dress Code

    Heritage Lounge/Gorgie Suite/Executive Lounge: smart, no trainers, no casual jeans (dress denims permitted), ties optional

    The Strongbow Legends Lounge: smart casual, no away colours

    Cancellations

    In the event of cancellation of any booking by a client, the client shall pay to the Club a cancellation fee calculated as follows:

    Notification Times and Cancellation Charges

    15–8 days prior to the event 25% of booking value 7-4 days prior to the event 50% of booking value Within 3 day of the event 100% of booking value

    Cancellation fees payable may be waived or reduced at the sole discretion of the Club.

     

    Obligations

    Clients shall be responsible for the orderly conduct of their guests and shall ensure that nothing is done or omitted to be done that will constitute a breach of the law, or in any way cause nuisance to or be an infringement of an occasion, or lead to possible forfeiture or endorsement of any licence for the sale of alcohol. The Club reserves the right to eject any persons who are deemed to be drunk, abusive or causing a nuisance to other guests or staff. The Club can accept no responsibility for the property of clients and guests in attendance at match day hospitality. Any items deposited in the Gorgie Suite Cloakroom and designated hanging areas in relation to the Executive European Lounge, Strongbow Legends Lounge, Heritage Lounge, Skyline Lounge, and Directors Box, shall be at the owner’s own risk and without obligation on the part of the Club.

  • The Club reserves the right to change its advertised fixtures without notice and without liability. The fixtures cannot be guaranteed to take place on a particular day at any particular time.

  • The Club cannot guarantee that the seat of the client or guest will not be affected by adverse weather conditions. Standing is forbidden in seated viewing areas of the Stadium. Foul, abusive or racist language or conduct is totally forbidden within the Stadium. Please note that the Club operates a non-smoking policy at the Stadium. The Stadium is covered by C.C.T.V, which is operated by the Club and recorded on a 24 hour basis.

    Please note that it is an offence punishable by law for any person to enter or attempt to enter the Stadium: 1. Whilst in possession of a prohibited container which is or was capable of holding liquid and which if thrown would be capable of causing injury to another person. 2. Whilst in possession of alcohol. 3. Whilst drunk. 4. Whilst in possession of any article or substance whose main purpose is the emission of a flare for purposes of illuminating or signalling or the emission of smoke or a visible gas. 5. Whilst in possession of any article which is a firework. Note: all persons entering the ground may be searched by the police.

    Nothing in these Terms and Conditions shall limit either party’s liability for death or personal injury caused by its negligence, or fraudulent misrepresentation. However to the fullest extent permissible neither the Club nor any of its Officers or Agents shall be responsible for any loss, damage or injury suffered by any client, or any guest, in or upon any part of the Stadium or car park offered for use as part of the match day hospitality or for any loss of profit, loss of use, loss of opportunity or any indirect economic or consequential losses whatsoever.

  • By entering a competition on Heart of Midlothian’s website or social media channels you are agreeing to the club storing and using your information for marketing purposes; we will not share your information with any third party without your permission. Your details will be added to the club’s database and you will receive promotional emails from time to time. You can opt out at any time by clicking on ‘unsubscribe’ on any email received. If adding any photos/videos to our social media channels, you are granting permission for these images/videos to be used online by Heart of Midlothian Football Club (HMFC).

    By submitting photos/videos you understand and agree that HMFC, has no obligation to publish your photos/videos. You must be the author/copyright holder of any images/videos submitted in connection with a competition. Entries must be submitted no later than 23:59 on the closing date advertised. The competition winner(s) will be announced within 48hrs of the winner(s) accepting the prize.

    Entry rules: please read the following rules carefully. If you enter one of our competitions, we will assume that you have read these rules and agree to abide by them:

    a) To enter this competition you must be 18 years of age or older at the time of entry.
    b) Employees of HMFC, their friends and members of their immediate families are not eligible to enter.
    c) All entries must be via channel indicated in the competition description.
    d) Incorrectly completed entries will be disqualified.
    e) No responsibility can be accepted for entries that are not received for any reason whatsoever.
    f) The winner will be the entrant(s) selected by a judge (or number of judges) as appointed by HMFC.
    g) The judging decision is final and no correspondence will be entered into.
    h) The closing date is as specified: however, HMFC reserves the right to amend the competition end date at any time.
    i) If you win this competition, we will notify you by either email or phone. If we cannot contact you or you do not respond within 48 hours, we reserve the right to offer the prize to another competition entrant, and so on, until the prize is claimed.
    j) The listed prize is non-negotiable.
    k) The prize is non-transferable to any other person.
    l) No prize or part of a prize is exchangeable for cash or services.
    m) If an advertised prize is not available, we reserve the right to offer an alternative prize or similar value.
    n) In the event of any promotional partner failing to provide any element(s) of any competition prize for any reason whatsoever, HMFC will act in good faith to endeavour to replace that/those element(s), but cannot be held responsible for that/those element(s) not provided.
    o) Please read our Terms of Use that explains how we use any personal information we collect and store from competition entries.
    p) HMFC reserves the right to amend these rules at any time. We may also create rules that will apply to a specific competition only. If we do this we will publish the amended competition rules and/or specific competition rules on the relevant competition page.
